Recent statements made by Minister Faith Muthambi at the Parliamentary Briefing of the Communications Committee yesterday are worrying as yet again the Minister Muthambi has over extended the powers that her position holds.
Minister Muthambi gave an incorrect reading of the law when she said that the Companies Act supercedes the Broadcasting Act and that the SABC should be treated as a state-owned enterprise with Minister Muthambi acting as the main shareholder.
We wish to remind the Honourable Minister that the SABC is first and foremost a PUBLIC broadcaster. The constitution is the only law that supersedes any other, and the Companies Act and the Broadcasting Act need to be read together in matters relating to the governance of the SABC. The SABC is not like other parastals such as Eskom and Transnet. It operates in the field of ideas, knowledge and opinions.
